Provisional Waiver Expansion Opens the Door to More Immigrants

The Department of Homeland Security (DHS) published new regulations expanding the provisional waiver, a process that permits certain undocumented immigrants that have U.S. citizen spouses or parents to effectively obtain pre-approval for reentry before they submit an application for immigrant visas in their country of origin. Underneath the new regulations, DHS can accept applications to the provisional waiver from individuals who have Lawful Permanent Resident (LPR or green card holder) spouses or parents.
